IP/Likelihood of Confusion
March 2023
S10 Entertainment & Media LLC v. Samsung Electronics Co. Ltd.
Jury finding of no trademark infringement and zero damages.
S10 Entertainment, a talent management company, sued Samsung for using the S10 name for a new generation of its Galaxy S-series smartphones, alleging that it would cause consumer confusion.
Voluble supported a marketing expert retained by Samsung. Voluble analyzed Samsung’s marketing strategy for its Galaxy S-series of smartphones and the consumer response to its efforts. The analysis demonstrated that Samsung’s Galaxy S-series had high awareness among U.S. consumers and that consumers linked the “S+number” naming convention to the S-series, leaving little opportunity for confusion. In March 2023, a jury agreed, awarding Voluble’s client a favorable ruling of no infringement and no damages.
